Navy and Marine Corps Court of Criminal Appeals rejects DWI Ruling
The Navy and Marine Corps CCA has ruled that the Navy’s rule forcing Sailors to inform their commanding officers that they have been arrested for an off-base drunken driving offense is unconstitutional and a violation of the Fifth Amendment. The Navy has not commented on the ruling. It is expected that the ruling will go to the Court of Appeals for the Armed Forces. If the ruling is upheld, it could open the door for Navy personnel to fight past military convictions for failing to report a DWI. The Marine Corps has no rule requiring Marines to self-report civilian arrests.
