Military-Veterans Advocacy and John Wells, a member of the AUSN Board of Directors, participated in oral arguments before the Court of Appeals for the Federal Circuit on Friday, Nov. 8, in an attempt to force the Department of Veterans Affairs to lift a stay on benefits claims for 90,000 Blue Water Navy veterans.
While the stay remained in place for the time being, the VA assured Judge Kimberly Moore — who also authored the Procopio decision — that it would not seek to extend the stay beyond Jan. 1.
In addition, the Department of Justice lifted the stay against Alfred Procopio — the lead plaintiff in the Procopio case earlier this year — on Nov. 6, two days before oral arguments, MVA said in a statement.
Wells said Friday’s outcome was a strategic victory.
“One of our goals was to ensure that the stay was not reissued or extended,” Wells said. “We achieved that. Now we have to wait for the court to decide whether the stay was illegal or not.”
